INTERNATIONAL LEGAL COOPERATION BETWEEN UKRAINE AND FATF DURING MARTIAL LAW

Abstract

The article is devoted to the analysis of international legal cooperation between Ukraine and the FATF (Financial Action Task Force on Money Laundering) under the conditions of the legal regime of martial law on the territory of Ukraine. The article defines the legal basis for the functioning of the FATF and analyzes its cooperation with Ukraine during the military conflict on the territory of Ukraine. The important role of international cooperation for Ukraine today is emphasized separately. Of great moral and political significance was the adoption by the UN General Assembly of resolutions No. ES-11/1 dated March 2, 2022 and No. A/ES-11/L.2 dated March 24, 2022, where the international community by an absolute majority condemned the violation of international law by the Russian Federation (RF) on the territory of Ukraine. The work of the FATF since 2022 has also taken place in the paradigm of commitment to international peace and security, and cooperation with Ukraine has focused on restrictive measures and sanctions pressure on the Russian Federation. The FATF's activities were largely devoted to countering the legalization of criminal funds from crypto-currency operations, illegal cyber activity and illegal arms trade. In the article, the author especially emphasizes the increased attention to financial security in many countries of the world and their associations, and, above all, in the European Union, which is evidenced by a number of acts of both internal EU law and international law. The comparative table of the article, in chronological order starting from 2022, reflects the legal actions and political statements of the Ukrainian side to the FATF and the FATF’s responses to them. The conducted analysis shows the FATF's support for international sanctions against the Russian Federation, the further application of restrictive measures to this country by the FATF, which ultimately leads to a limitation of the financial capabilities of the Russian Federation in conducting a military operation on the territory of Ukraine.
