FUNDAMENTALS OF STATE POLICY OF UKRAINE IN OIL AND GAS INDUSTRY: NORMATIVE REGULATION

Abstract

The article is devoted to the study of regulatory and legal support for the formation and implementation of the state policy of Ukraine in the oil and gas complex under the conditions of the special regime of martial law. Attention is paid to general and special legal regulation, an analysis of the content and scope of the main category, such as "state policy" in the context of comparison with the concepts of public administration and regulation, is carried out. The principles of state policy in the oil and gas industry have been studied, which indicates a clearly defined state approach to the formation and implementation of political directions and a high level of interest of the subjects of power in creating proper conditions for the functioning of the oil and gas sector, the market for the sale of products of the oil and gas industry. It has been found out that today the legislation enshrines an approach according to which categories of state regulation and state policy are identified, which is not correct from the point of view of the foundations of the theory of administrative law and has a negative effect on the further delimitation of powers in terms of institutional support for the functioning of the oil and gas sector. It was concluded that the state policy in the oil and gas sector is aimed at creating safe conditions for the functioning of the market and the distribution of resources between end consumers, the liberalization of the competitive environment, and the promotion of economic growth of enterprises in the oil and gas sector. At the same time, under the conditions of the special regime of martial law, it is important to take into account the volatility of energy sources sales markets and direct financial and organizational efforts to guarantee the availability of energy sources, which at the moment is not provided for by the current regulatory and legal regulation. It was additionally clarified that the state policy should also be aimed at autonomy from imports, which can be realized only under the condition of comprehensive organizational planning and taking into account the interests of business representatives.
