HISTORICAL ORIGINS OF THE FORMATION OF POLITICAL RIGHTS OF PUBLIC SERVANTS

The article is devoted to a retrospective legal analysis of the formation and development of political rights of public servants. It is found that in the doctrine there are two dominant approaches to determining the time limits of the formation of the origins of this category of rights. According to the first approach, the emergence of the institute of political rights is closely connected with the formation of the first generation of human rights and the normative consolidation of these rights at the level of legal acts, which took place in the 17th–18th centuries. According to the second approach, the origins of political rights date back to archaic times. It is noted that historically the first manifestations of the institute of political rights of persons endowed with public authority can be considered the realization of their right to be elected or appointed to positions, as well as the right to participate in public affairs. It is emphasized that the historical origins of the political rights of public servants in Ukraine date back to the times of the Kievan Rus. The features of the implementation of political rights of public servants during the period of the Kievan Rus (9th century), the Kingdom of Galicia–Volhynia (12th–14th centuries), the Lithuanian-Polish period (mid-14th – mid-17th centuries), the period of the Zaporozhian Sich and the Ukrainian Cossack State (second half of the 16th–18th centuries), the period of the presence of Ukrainian lands in the Russian and Austro-Hungarian Empires (late 18th – early 20th centuries), the period of the Ukrainian Revolution of 1917-1921, the period of Ukraine in the USSR (1920s – 1980s of the 20th century) and the period of Ukraine gaining independence in 1991 are analyzed. Based on the research conducted, the author concluded that the formation of certain political rights of public servants on the territory of Ukraine occurred during the period of the Kievan Rus, the period of the Kingdom of Galicia–Volhynia and the Lithuanian-Polish period. The revival of the development of these rights occurred during the time of the Ukrainian Cossack State. A certain “stagnation” is observed during the period of the presence of Ukrainian lands in the Russian and Austro-Hungarian Empires. The beginning of the 20th century is characterized by a gradual expansion of the complex of political rights, which were narrowed during the time when Ukraine was part of the USSR. After Ukraine declared independence, under the influence of international standards for the protection of human rights, significant progress has been observed in the development of political rights of public servants.
