ALGORITHMIC LAW AS AN INTERDISCIPLINARY PHENOMENON: ITS IMPACT ON THE TRANSFORMATION OF STATE SOVEREIGNTY

Abstract

The article provides a comprehensive theoretical and legal analysis of the transformation of state sovereignty in the context of the proliferation of automated decision-making systems and the implementation of artificial intelligence technologies. The relevance of the study is обусловлена the intensive digitalization of state functions, within which algorithmic systems increasingly perform functions that traditionally belonged exclusively to public authorities, thereby objectively influencing the nature of governmental powers and the mechanisms of their exercise. The aim of the study is to conceptualize algorithmic law as a new interdisciplinary phenomenon of contemporary legal reality and to determine its impact on the transformation of traditional notions of state sovereignty. The methodological framework of the research is based on general scientific and special legal methods of inquiry, including systemic, structural-functional, comparative-legal, and interdisciplinary approaches. These approaches integrate the achievements of legal theory, philosophy of law, and digital technologies, enabling a comprehensive assessment of the legal nature of algorithmic decision-making. The study analyzes contemporary scholarly works of European and Ukrainian authors published between 2023 and 2025, as well as national and international legal acts regulating artificial intelligence and automated decision-making. It is substantiated that algorithmic systems transform sovereignty from a model of exclusive state authority into a polycentric form of algorithmic governance, which involves the interaction of state institutions, international organizations, and private digital actors, as well as the formation of new mechanisms for the distribution of public powers. It is demonstrated that software code acquires features of normativity and functions as a regulatory instrument of social relations. The necessity of the legal institutionalization of algorithmic law is argued, along with the introduction of mechanisms of algorithmic accountability, transparency, and oversight as key conditions for preserving digital sovereignty and ensuring the rule of law in the context of automated decision-making. It is noted that, in the future, algorithmic law may become a key condition for the formation of an effective and democratically oriented digital state. Particular attention should be paid to the development of domestic digital platforms capable of ensuring the technological independence of the state.
