USE OF ARTIFICIAL INTELLIGENCE IN THE ACTIVITIES OF PUBLIC AUTHORITY BODIES: ADMINISTRATIVE AND LEGAL REGULATION

Abstract

The article examines the features of the implementation and use of artificial intelligence technologies in the activities of public authorities. Scientific approaches to understanding artificial intelligence and its place in the system of public authority functioning are presented. The main regulatory prerequisites for its regulation and possible implementation in the public sector are analyzed. The need for regulatory regulation of the use of AI is substantiated in order to further its dissemination and development, as well as to avoid possible negative manifestations of the implementation of this technological solution for the legal status and level of protection of individuals. The legislation of the European Union is analyzed in terms of regulating the use of artificial intelligence, the main approaches and principles of its use in the field of public administration are determined. Special attention is paid to the regulatory analysis of the current legislation of Ukraine in the area under study. It is proposed that the features of AI in the field of public authority functioning at this stage of technological development include: the presence of a regulatory framework for implementation, which is positively noted in the improvement of public management and administration processes; the possibility of implementation through the relevant activities of specific state authorities, which in turn form and implement the state's digital policy (Cabinet of Ministers of Ukraine, Ministry of Digital Transformation of Ukraine, State Service for Special Communications and Information Protection of Ukraine, relevant ministries), which indicates the presence of an institutional component in the system of administrative regulation of the use of AI; the belonging of artificial intelligence to a modern digital technological solution, which can be implemented through an integrated approach. The main problematic aspects of the implementation of artificial intelligence are separately identified, which indicates the need to find optimal mechanisms for its administrative and legal regulation at the current stage of the digital transformation of the public sector of Ukraine.
