HISTORY OF FORMATION OF ADMINISTRATIVE JUSTICE OF UKRAINE

Abstract

The article is devoted to the history of the emergence, formation and development of admin- istrative justice on the territory of modern Ukraine, starting from the first steps to its current state, opinions were expressed regarding the prospect of further intelligence in this direction.The concept of administrative justice and the need to create it for effective guarantee of human rights in relations with the authorities are substantiated, taking into account the principle of sep- aration of powers into legislative, executive and judicial. The process of emergence of prereq- uisites, formation and development of administrative justice is divided by us into stages, taking into account periods in the history of our country. These include: the time period of the existence of Kyivan Rus, when the word “court” was first mentioned in the Statute of Prince Volodymyr Svyatoslavovych “On Tithes, Courts and Church People”, when during the time of Ruska Prav- da the concept of responsibility of officials arose, which became a prerequisite for control over power; the time period of the existence of the Lithuanian statutes (1529, 1566, 1588) – which contained norms that regulated the activities of government officials, as well as the mecha- nisms of their responsibility and according to which judicial instances appeared for the first time independent of the executive power; during the time of the Zaporizhzhya Army, when under the “Pacts and Constitutions of Laws and Freedoms of the Zaporizhzhya Army” the principle of separation of powers, control over power, protection of rights and freedoms, judicial sys- tem, European context took place; formation of judicial and administrative bodies on problems of administrative justice 1743–1917 as part of the Austro-Hungarian and Russian empires, Polish Commonwealth; revival of Ukrainian independence 1917–1923; Soviet period; administrative justice at the time of independence. The justification for the fact that this process of formation continues its existence to this day is given. The importance of studying the historical processes of the emergence, formation and development of administrative justice in the lands of modern Ukraine in different periods is substantiated.
