LEGAL ENSURING THE ACTIVITIES OF THE MINISTRY OF ІNTERNAL AFFAIRS OF UKRAINE DURING THE LEGAL REGIME OF MARTIAL STATE

The article is devoted to the normative analysis of the powers and tasks of the Ministry of Internal Affairs of Ukraine during the period of the special legal regime of martial law. It was found out that the Regulation on the Ministry of Internal Affairs of Ukraine does not provide that this subject of power legally takes direct part as a subject of ensuring the martial law of Ukraine, however, the analysis of the specified powers confirms that the body is responsible for maintaining national security and law and order, as well as protecting the population. Attention is paid to those regulatory changes that were adopted after the introduction of the legal regime of martial law in Ukraine. It was found that most of the changes were aimed at expanding the powers of the Ministry of Internal Affairs of Ukraine and other executive authorities and subjects of power under the Ministry of Internal Affairs. It was established that the powers of the ministry were significantly expanded in terms of providing humanitarian protection, information, and technical assistance to other authorities, searching for missing persons under special circumstances, and the powers in terms of the economic security of the state were supplemented. Changes in the powers of the National Police of Ukraine, the State Border Service of Ukraine, and the National Guard of Ukraine were analyzed. It was found that the provision regarding the specifics of public control over police activities during martial law is quite debatable, which effectively deprives citizens of the right to participate in the consideration of complaints about the actions or inaction of police officers, to familiarize themselves with activity reports, etc. It was concluded that the Ministry of Internal Affairs of Ukraine remains one of the key bodies that must guarantee the safety of the population and law and order in the state during the legal regime of martial law. The complex structure of the body and the presence of other state bodies subordinated to the Ministry of Internal Affairs of Ukraine testify to a long and dynamic process of improving the regulatory and legal regulation of activity issues, the constant need to adapt legislation to the requirements of society, and timely response to the needs of citizens. The consolidation of clearly defined tasks for the Ministry of Internal Affairs of Ukraine during the period of martial law, which objectively follow from the analysis of existing legislation, seems promising.
